Terms and Conditions for MatchCustomerNames
Last updated: 1/28/2026
1. Introduction
These Terms of Service ("Terms") govern your (the "Customer") access to and use of the MatchCustomerNames website located at https://MatchCustomerNames.com (the "Website") and the automated data cleaning and formatting services (the "Service") trading under App de Bock (the "Company"). By accessing the Website, uploading files, or purchasing Credits, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.
2. User Accounts and Security
To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify the Company immediately of any unauthorized use of your account or any other security breach. The Company is not liable for any loss or damage arising from your failure to protect your account information.
3. Service Model: Credits and Subscriptions
The Service operates on a "Credit" system.
- Definition: "Credits" are the virtual currency used to pay for data processing operations (e.g., merging rows, formatting cells).
- Usage: Credits are deducted from your balance only when you choose to export or download a processed file. Uploading and previewing data is free.
- Expiration: Pay-As-You-Go Credits do not expire as long as your account remains active.
- No Resale: You may not sell, license, or transfer Credits to any other person or entity.
4. Packages and Payment
You can purchase Credit packages through the Website. By purchasing a package, you are granted a non-exclusive, non-transferable license to use the Service in accordance with the terms of your purchased package. All prices are in Euros unless otherwise stated.
5. Refunds
You are entitled to a full refund within fourteen (14) days of your purchase, provided that you have not used any of the purchased Credits. Once a Credit has been consumed (i.e., you have downloaded a cleaned file), that portion of the purchase is considered "service rendered" and is non-refundable. Refunds may be subject to a transaction processing fee of €5.00, deducted from the refund amount to cover payment gateway charges. To request a refund, please contact us at [email protected].
6. User Data (Account Info) vs. Processed Data
It is important to distinguish between two types of data:
- Account Data Your name, email, and billing information. The Company acts as the Data Controller for this data. See our Privacy Policy for details.
- Processed Data The content of the CSV files you upload. The Company acts as the Data Processor for this data. This is covered strictly in Section 9 below.
7. Intellectual Property
The Website, the underlying algorithms (including fuzzy matching and deduplication logic), the MatchCustomerNames brand, and the interface design are the intellectual property of the Company. You are granted a limited, non-exclusive license to use the Service for your own personal or commercial use. You may not reverse engineer, decompile, or disassemble the Service or try to derive the source code.
8. Disclaimers
The Service is provided "as is" and without warranties of any kind, express or implied. The Company disclaims all warranties, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
Accuracy Disclaimer: While our Service uses advanced logic to clean data, automated data cleaning is not infallible. You acknowledge that the Service may occasionally merge incorrect records (false positives) or miss duplicates (false negatives). You are solely responsible for reviewing and verifying the changes via the "Preview/Diff" view before downloading the final file.
9. Data Processing Agreement (DPA)
9.1 Scope and Roles
This section applies to the processing of data uploaded by the Customer to the Service (the "User Data": CSV files, and cell contents). In this context, the Customer is the Data Controller and the Service Provider (App de Bock) is the Data Processor.
9.2 Documented Instructions
The Processor shall process the User Data only on documented instructions from the Controller. The Customer's action of uploading a file and clicking "Process" or "Clean" constitutes the instruction to process the data for the sole purpose of returning a formatted/cleaned file. The Processor shall not process this data for any other purpose (e.g., marketing, data mining, or model training) without explicit consent.
9.3 Confidentiality
The Processor ensures that all personnel authorized to process the User Data have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality.
9.4 Security
The Processor implements appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including the use of TLS/SSL encryption for data in transit and processing in secure, EU-based data centers (where applicable).
9.5 Sub-processors
The Controller grants a general authorization to the Processor to engage sub-processors. The Processor utilizes reputable cloud infrastructure providers (Railway.app, Supabase) located within the European Economic Area (EEA) for hosting and computation. The Processor shall inform the Controller of any intended changes concerning the addition or replacement of sub-processors.
9.6 Assistance to the Controller
Taking into account the nature of the processing, the Processor shall assist the Controller by appropriate technical and organizational measures, insofar as this is possible, for the fulfilment of the Controller's obligation to respond to requests for exercising the data subject's rights (e.g., Right to be Forgotten).
9.7 Retention and Deletion of Data
The Processor follows a strict data minimization model.
- Temporary Storage: Processed files are stored strictly for a limited window (72 hours) to allow the Customer to download the result.
- Deletion: After this window expires, User Data is automatically and permanently deleted from the Processor's servers.
- Termination: Upon termination of the account, all User Data is deleted unless European Union or Member State law requires storage.
9.8 Audits
The Processor shall make available to the Controller all information necessary to demonstrate compliance with the obligations laid down in Article 28 of the GDPR.
9.9 Customer Obligations
The Customer represents and warrants that it has a valid legal basis to process the User Data and to transfer it to the Service Provider. The Customer is solely responsible for ensuring the uploaded data does not contain illegal content and for ensuring the accuracy and lawfulness of the data provided to the Service.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:
- Your use or inability to use the Service;
- Any errors, inaccuracies, or data loss resulting from the automated cleaning process;
- Unauthorized access to your transmissions or content.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
12. Updates to the Terms
The Company may update these Terms at any time by posting a new version on the Website. You are advised to review the Terms periodically for any changes. Your continued use of the Website or Service after the posting of any revised Terms constitutes your acceptance of the revised Terms.
